What is Conveyancing?
Conveyancing is the legal process of transferring the legal title of real property from one person (the seller) to another person (the buyer).
The Conveyancing process typically involves the following steps:
Pre-Contract
Reviewing the Contract of Sale and conducting pre-exchange searches on the property on behalf of a Purchaser.
Obtaining prescribed documents and attending to preparation of Contract for Sale for marketing purposes on behalf of Vendor.
Contract
Signing and exchanging the Contract of Sale. Exchange of Contracts is usually when the Contract becomes binding on both the Vendor (seller) and Purchaser (buyer) unless there is a cooling off period in place.
Pre-Settlement
Conducting post exchange searches, preparation of settlement statement and preparing for settlement.
Settlement
Attending to preparation of the electronic workspace for settlement, arranging the transfer of ownership and disbursements of settlement money and completing any other settlement tasks. Once settlement has been completed the Purchaser receives the keys and can start moving into the property.
Post Settlement
Notifying authorities to update records and attending to any other post settlement matters.
